Sentence: 4 Years For Guilty against Possible 46.5 Years Otherwise

FRANKFORD — A former student-teacher at a Sussex County elementary school would be sentenced to four years in prison if she pleads guilty to having sexual relations with one of her students, under a plea bargain offer made today.
Lindsay Massaro, 25, was given until Feb. 14 to accept the offer, which would require her to plead guilty to one count of second-degree sexual assault.

Superior Court Judge N. Peter Conforti, sitting in Newton, told Massaro that she could face up to 46½ years in prison if she is convicted of all of the six charges against her, including first-degree aggravated assault. The judge also said Massaro would be required to undergo a psychosexual evaluation to determine if she was a "compulsive and repetitive" sexual offender and would be subject to Megan’s Law supervision for life.
Massaro, a former eighth-grade student-teacher at the Frankford Elementary School, was arrested March 30, 2009, and accused of having a sexual relationship with a student, according to her arrest affidavit. The boy was at least 13 and younger than 16, the affidavit said.
Massaro is accused of having sexual trysts with the boy in her car in Branchville and in the bedroom of her home in Frankford in the days prior to her arrest. According to the affidavit, Massaro admitted having a consensual sexual relationship with the boy.
